USE OF SUBMISSIONS  

 

All Submitted Content: By submitting, each submitter (on behalf of entrant and his/her child) grants Ethan Nicolle (Owner) and his designees a perpetual worldwide irrevocable license in any and all media to exploit, edit, modify, and distribute the Submitted Content, and all elements of such submission, including, the child’s first and last name and city and state of residence (unless otherwise specificed), for advertising, promotion, trade and other purposes, in any and all media, now or hereafter devised (including the Owner's website and/or social media pages), in any manner, in whole or in part, together with other materials including, without compensation or notification to, or permission from, entrant or any third party.  

 

Submissions may only be used as inspiration and not as exactly submitted.  In addition, Owner may decide to only use part or portions of the submission.  Submitter understands that neither they nor his/her child will have approval over how the submission is presented on the site or other uses such as books or videos. Winner understands that neither the winner nor his/her child will receive any compensation from any sales they may contain submitted content.

Submitter (on behalf of submitter and his/her child) understand and acknowledge that (i) Owner has wide access to ideas and that new ideas are constantly being submitted to Owner, including in connection with this website, or being developed by its own creative team; ii) the work submitted by entrant may be similar to, or identical to, other Entries; and iii) neither submitter nor his/her child will be entitled to any compensation as a result of Owner’s selection or use of the submitted work or any such similar or identical idea. Submitter (on behalf of submitter and his/her child) agrees that Owner shall not have any liability to Submitter or his/her child for any direct, indirect, contributory, vicarious, secondary or other infringement or protection of any copyright in or to submitter submitted content.

 

PUBLICITY GRANT: Each Submitter (on behalf of Submitter and his/her child) agrees to the use by Owner and its designees of his/her name, his/her child’s name and/or likeness, city and state of residence and Entry for advertising, promotional and other purposes, in any manner, in any and all media, now or hereafter known, worldwide in perpetuity, without further compensation or notification to, or permission from, Submitter or his/her child, unless prohibited by law.

GENERAL CONDITIONS:  By submitting content, each Submitter (on behalf of Submitter and his/her child) agrees: (a) to abide by decisions of Owner, which shall be final and binding in all respects relating to use of submitted content; and (b) to release, discharge and hold harmless Owner, its parent, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from submitting content or any submission-related activity.

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, illegible, stolen, delayed, misdirected, undelivered, or garbled Submissions or mail; or for errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the submitted content, including, without limitation, errors or difficulties which may occur in connection with the administration of Rocket Monster Story Club, the processing or choosing of content, or in any content-related materials.  CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SITE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, OWNER RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
